What is Statutory Sick Pay and Do I Have to Pay it?

All UK employees are entitled to Statutory Sick Pay (SSP) when they are ill, provided they meet the eligibility requirements. To receive SSP, an employee must:

  • Have a contract of employment that they have done some work under
  • Been off sick for 4 or more consecutive days
  • Earn at least £113 per week
  • Have given their employer the correct notice (usually set by the employer or, if not, defaults to 7 days)
  • Provide proof of their illness, i.e a fit note from their doctor (only necessary after 7 consecutive days of absence)

Once an employee meets all these requirements, they are entitled to £92.05 SSP per week they are absent for a period of up to 28 weeks. If the employee is late In giving their notice to their employer, the employer doesn’t have to pay them SSP for the late days. The first 3 days of a period of illness are not counted in SSP calculations.

Some company’s offer their own sick pay scheme where they can offer employees a higher rate per week (though they can’t offer less) and set their own notice period for employees.
