Don’t DIY when it comes to HR or Safety

After what has been a very unusual year for businesses, what has become clear to us is that there are lots of businesses out there that have taken a DIY approach to their HR or Health & Safety within their business – some of which have fallen foul to this during the pandemic.

Staff are by far your biggest asset and cost and taking a DIY approach to key elements like contract, policies, risk assessments can turn this asset into your biggest liability. Not something that businesses need right now.

As it is a legal requirement to provide Employment Contracts on day 1 of employment then having these resources in place before you employ for the first time is essential. For businesses that may be taking on their first employees then perhaps budgets are tight and so a common misconception is that free templates on the internet or old employment contracts from precious employment will do the job – sadly, that’s not always the case. We have seen several businesses fall foul to this during the pandemic where they may have experienced issues with employees or employees have left of their own volition and then they find their businesses are exposed.

When it comes to Health & Safety then the same applies. As there are no legal requirements to have written documentation when you employ less than 5 staff, many businesses may wrongly think they have no requirement to manage Health & Safety until they get to 5 employees, but this couldn’t be further from the truth. The safety of your employees is your responsibility from the day you employ them even if you do not have to document this in writing. This means you still have to have a policy for how you are going to manage safety and assess the risks your staff are likely to be open to. If you fail to do this and there is an incident or accident at work, then the liability still falls with you as the employer – therefore it is so important to get guidance from an expert.
