Compromise Agreements

These are becoming a more popular way of ending an employment relationship to ensure that the employee waives the rights to come back to a former employer with any type of claim after their employment has been terminated.

Typically these agreements are used when there are spcific issues or circumstances that would prevent the normal procedures for terminating employment to be followed. A compromise agreement also makes an allowance for a tax free compensation payment to be made to the employee to end the employment relationship.

It is essential that you receive guidance and advice as to whether a compromise agreement is appropriate to the situation and that the clauses within this provide sufficient protection for your business.

Employment Tribunals

Although having robust HR procedures in place will avoid issues escalating to a tribunal an employee or ex employee can still submit a claim regardless of whether they have sufficient grounds to do so.
